Rome Court Rules Netflix Subscription Price Hikes Illegal

A court in Rome has delivered a significant ruling regarding Netflix's subscription price increases in Italy, declaring several of these hikes illegal and imposing substantial financial repercussions on the company.

A court in Rome has issued a landmark decision concerning Netflix's subscription price increases in Italy, ruling that several of these hikes were illegal. This ruling could have serious financial implications for the company, as the court has mandated that Netflix reimburse users for overcharges, which could amount to hundreds of euros for each subscriber.

According to a report by Interesting Engineering, the court determined that Netflix violated consumer protection laws when it raised prices for its services without clearly stated reasons in its user agreements. The case against the company was brought forth by the Italian consumer organization Movimento Consumatori, which advocated for consumer rights.

The judges meticulously examined how clearly Netflix communicated potential future price changes. Under Italian law, companies are required to explicitly state the reasons for altering contract terms. In its ruling, the court noted that the platform failed to meet this requirement, resulting in illegal price increases.

Specifically, the ruling addresses price hikes that occurred between 2017 and 2024. The court deemed these increases legally invalid, emphasizing that even warnings to users or the option to cancel subscriptions cannot replace transparent terms in the contract.

Lawyers Paolo Fiorio and Corrado Pinna explained that the illegal increases for the premium plan totaled 8 euros per month, while for the standard plan, the increase was 4 euros. They noted that a premium subscriber who has been paying since 2017 could receive approximately 500 euros in compensation, while a standard subscriber could expect around 250 euros.

The court also ordered Netflix to notify all affected users within 90 days through various channels, including email and public announcements. Failure to comply with this obligation could result in a fine of 700 euros for each day of delay.

Additionally, the court mandated that the company reduce current prices in light of the illegal increases. For instance, a premium plan user who subscribed in 2017 and is currently paying 19.99 euros is entitled to receive the same services for 11.99 euros.

The Movimento Consumatori organization stated that they may file a class-action lawsuit if Netflix does not comply with the court's ruling. This underscores the seriousness of the situation and the consumers' readiness to defend their rights.

In response, Netflix representatives have announced that the company plans to appeal the decision. One company spokesperson remarked that Netflix takes consumer rights seriously and believes its terms were in compliance with Italian law.

Since April 2025, the company has updated its terms of service, outlining the circumstances under which prices may change, including for technical or regulatory reasons. This update may be part of Netflix's strategy to avoid similar situations in the future.

While this ruling pertains only to Italy, it could have implications for other countries, as regulators worldwide are increasingly scrutinizing how streaming services justify subscription price increases. This may lead to changes in pricing practices across the industry, undoubtedly affecting millions of users globally.
