Ukrainian Parliament Approves Law on Adapting National Legislation for Accreditation of Conformity Assessment Bodies to EU Standards

On April 7, 2025, the Verkhovna Rada of Ukraine approved in its second reading the bill No. 12221, aimed at harmonizing the accreditation of conformity assessment bodies with European Union requirements.

The Verkhovna Rada, Ukraine's parliament, took a significant step towards aligning its accreditation system with European Union standards by approving bill No. 12221 during a session on April 7, 2025. The legislation received overwhelming support, with 278 members of parliament voting in favor, no votes against, and 19 abstentions.

This legislative initiative, crafted by the Ministry of Economy, Environment, and Agriculture, was developed in collaboration with business representatives, industry associations, expert communities, and international partners. It is considered a crucial milestone on Ukraine's path to signing the Agreement on Conformity Assessment and Acceptance of Industrial Products (ACAA), often referred to as the 'industrial visa-free regime.'

According to the explanatory note accompanying the bill, the legislation aims to bring Ukrainian laws in the field of accreditation of conformity assessment bodies and technical regulation closer to European norms. One of the key features of the bill is the introduction of mutual recognition of accreditations conducted in Ukraine and the EU. This means that Ukraine will acknowledge the results of accreditations carried out by EU member states, provided they have successfully undergone mutual evaluation.

Furthermore, if a Ukrainian manufacturer utilizes standards from EU countries that are identical to European harmonized standards, their products will be deemed compliant with the relevant requirements. This provision is expected to facilitate trade and enhance the competitiveness of Ukrainian goods in the European market.

The legislation also increases the accountability of businesses regarding the accuracy of information about their products. It establishes rules for interaction with the European Commission and authorities of EU countries within the framework of the ACAA Agreement. Additionally, it ensures balanced representation of all stakeholders in the National Accreditation Body and sets conditions for conducting cross-border accreditation.

The first reading of this bill took place on March 26, 2025, where it garnered support from 286 members of parliament. The swift progression of this legislation underscores the Ukrainian government's commitment to reforming its regulatory framework in line with EU standards, thereby enhancing its integration into the European market.

As Ukraine continues to pursue closer ties with the European Union, the approval of this law marks a pivotal moment in the country’s efforts to modernize its regulatory environment and improve the quality of its products.
