Italian Court Orders Netflix to Refund Customers for Illegal Price Hikes

The organization argued that the price increases for the streaming service violated the Consumer Code and Italian legislation. The court concurred with the plaintiffs' arguments and determined that the price changes that occurred in 2017, 2019, 2021, and 2024 were illegal.
According to the court's ruling, Netflix is obligated to reimburse affected customers amounts up to 500 euros, depending on the chosen subscription plan. The court emphasized that the contracts established with users did not provide adequate explanations for the reasons why prices and other terms could change. Although the company notified its subscribers about the price increases and the possibility of canceling their subscriptions 30 days in advance, this was deemed insufficient to comply with legislative norms.
The court also mandated that Netflix must inform its customers of their right to compensation within 90 days. This notification can be sent via both regular and electronic mail. It is important to note that for each day of delay in complying with this ruling, the company faces a fine of 700 euros.
According to data provided by Movimento Consumatori, as of October 2023, Netflix had approximately 5.4 million customers in Italy. This ruling could significantly impact the company's financial performance, given the number of subscribers who may be potential recipients of compensation.
