OnlyFans: Ukrainian Courts Overturn Fines for Content Creators
Ukrainian courts are increasingly siding with OnlyFans content creators who are contesting fines imposed by the State Tax Service (STS). At least 27 cases have concluded in favor of the plaintiffs, representing nearly a third of the total 94 cases currently before the courts.
In Ukraine, the judicial system continues to make significant rulings in favor of OnlyFans content creators who are challenging fines and additional tax assessments levied by the State Tax Service (STS). According to the OpenDataBot portal, at least 27 cases have ended with either partial or complete victories for the plaintiffs, which accounts for nearly one-third of the total 94 cases being examined in the courts.
The surge in court decisions favoring OnlyFans content creators is striking. In 2026 alone, 13 rulings have already been made, indicating a strong trend towards the protection of creators' rights. February proved to be particularly active, with five decisions rendered in favor of the plaintiffs during that month.
Data reveals that in 92% of the cases, courts sided with the content creators due to procedural violations by the STS. The tax service frequently sent documents to outdated addresses, resulting in returned letters, yet inspections continued unabated. Judges have deemed such inspections illegal, along with all associated tax assessments.
It is important to note that the STS often relied on letters from British tax authorities concerning payments from Fenix International Ltd, the company that operates OnlyFans. However, the courts emphasize that such letters serve merely as a basis for inspection rather than proof of income. In the absence of bank statements, contracts, or other primary documents, the additional tax assessments are considered unfounded.
Interestingly, one-third of the successful cases have been recorded in the Odesa region, where eight court decisions were made. The Dnipropetrovsk region follows closely with five cases. However, in some areas, such as Zhytomyr and Rivne regions, no victories have been recorded yet, despite open proceedings.
Among the notable successes for content creators is the annulment of the largest fine in Kyiv, where over 3 million hryvnias in taxes were overturned, which had been assessed on an alleged income of nearly $400,000. The plaintiff provided bank statements that did not corroborate the stated amounts, leading the court to rule in her favor.
In the Cherkasy region, a court annulled over 1.3 million hryvnias in taxes and fines due to a complete lack of primary documents. In Odesa, a fine exceeding 500,000 hryvnias was overturned due to a simple address error; the tax service failed to properly notify the individual about the inspection, which the court deemed illegal.
In the Ivano-Frankivsk region, one plaintiff independently contacted the British tax authority and received an official response confirming that no information about her had been transmitted there. Consequently, the STS relied on data that did not exist, leading the court to annul all assessments.
It is worth noting that recently, the founder of OnlyFans, Ukrainian-American businessman Leonid Radvinsky, passed away at the age of 43, which has sparked widespread media attention and concern among platform users.
